Hudson Votes to Defend the Constitution
WASHINGTON, D.C. – Today, U.S. Representative Richard Hudson (NC-08) released the following statement after voting in support of H. Res. 639, a resolution which authorizes the Speaker of the House to file an amicus brief on behalf of the House of Representatives to defend Congress’s Article I powers under our Constitution:
“Like my constituents, I am fed up with the president’s disregard for the rule of law, particularly when it comes to his unconstitutional executive amnesty. When he bypassed Congress and the American people’s concerns to unilaterally rewrite our nation’s immigration laws, he disrespected our nation’s separation of powers. The bottom line is the president’s actions were unlawful, and today’s resolution is an important step for the People’s House to speak for our constituents and defend our Constitution.”
H. Res. 639 is a resolution authorizing the House to file a friend of the court brief against the administration’s position in United States v. Texas, the Supreme Court case involving the president’s executive actions on immigration. In United States v. Texas, the Supreme Court is questioning if the president’s executive actions on immigration violate the president’s duties under Article II, Section 3 of the Constitution to “take care that the laws be faithfully executed.” Under Article I, “all legislative powers” are vested in Congress which means neither the president nor unelected bureaucrats are permitted to write laws.
