Hudson’s Medical Lawsuit Reform Passes
WASHINGTON, D.C. – Today, U.S. Representative Richard Hudson (NC-08), member of the Energy and Commerce Committee’s Health Subcommittee, released the following statement after the House passed the Protecting Access to Care Act (H.R. 1215), including his amendment(link is external) to implement reforms to the current medical liability system so it will better serve patients and physicians:
“As we’ve seen in several states, common sense medical liability reform helps ensure that deserving patients are fairly compensated for any medical injuries. These reforms have helped control health care costs and improve patient access – that’s the type of federal tort reform we need across the country.”
H.R. 1215 seeks to improve patient access to health care, provide improved medical care and save taxpayers nearly $50 billion by reducing the excessive burden the liability system places on the health care system. The bill would apply in instances where health care is provided through federal programs or supported by federal subsidies (including tax benefits), and is modeled after successful reforms implemented in California in 1976.
This legislation creates a federal standard to rein in frivolous medical malpractice lawsuits, however, it also provides states the ability to set their own standards. For a one-pager, click here(link is external).
